SUCCESSIONS

Successions

Succession is the transmission of the immovable property of a deceased person to a living person. This is called a transmission ‘Causa mortis’.

It is the will of the deceased person that determines who the heirs or legatees are. On the other hand, if no will is made, the law of intestate succession recognises certain family members, called heirs-at-law, as being entitled to the estate of the deceased person.

It is important to know that duty is charged on every immovable property transferred Causa Mortis at varying rates. Also, a Causa Mortis deed must be concluded within six months from the date of death in order to benefit from the rebate prescribed by law.
